Privacy Policy

This Privacy Policy applies to the Sweet Sadie Mae Character Corner at https://character.sweetsadiemae.com (the “Service”) and any other products, services, mobile applications and websites offered by Lucidbass, LLC  (“Company”, “us” or “we”).  This Privacy Policy applies to all information you may provide to us through the Service. Some of the terms used, but not defined, in this Privacy Policy are defined in our Terms of Service.

The Service

The Service has been designed to be an online resource for students and educators to explore character growth through interactive language arts lessons.   In order to make the Service work, we need to collect certain personal information from our users.   However, we also understand users may have some questions about how we use and maintain their information and how they may protect and control their privacy.   This Privacy Policy describes the information we collect and how we will use and disclose such information.  We want our users to feel comfortable using and sharing information on our Service and hope to become part of your educational community.

Information of Children

The Service is designed for use by both users over the age of 13 and users under the age of 13 with the proper consent. Please see our Children’s Privacy Policy below for a description of our specific policies for protecting the personal information of users under the age of 13.

Types of Data We Collect

Information you provide — When a Community enters into a Subscription Agreement to initiate use of the Service, we ask the Community to provide some basic personal information about the Community, the teachers and the students who will be using the Service.  The Community is asked to provide the name of the Community, its website (if any), the number of students and teachers who will be using the Service, an administrator or point person for all communications with the Community and the address of the Community.  The Community will be asked to provide the first and last name of the teachers that will use the Service, the grades and subjects they teach and a Community e-mail address for the teacher.  Pursuant to the requirements of our Children’s Privacy Policy below, the Community will be asked to provide the first and last name of each student that will use the Service, their birth date, and their class and teacher name.  Any user may view, update or change his or her account or profile information through the Service at any time.  Users may also provide additional information and data through their use of the Service, for example, by responding to test questions, creating messages to other users and the like.  Remember as part of a Community, other members of the Community may see certain information you provide through the Service. 

Cookies — When you use the Service, we may send one or more cookies to your computer or mobile device. We use cookies to improve the quality of our Service, including for storing user preferences improving search results, and tracking user trends, such as how people use our Service.

Automatically collected Information; Log information — When you access the Service via a browser, application or other device, our servers automatically record certain information. These server logs may include information such as your web request, your interaction with a Service, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser or your account.  When you use the Service using your smartphone or other mobile device, we collect information regarding device type, operating system, IP address and device ID.  As you interact with the Service, we obtain information regarding your interactions, such as time of day and date, how long you spend on different pages and the like. 

User communications — When you send communications to us or to other users through the Service, we may retain those communications in order to process your inquiries, respond to your requests and improve our Services.  We may use user email addresses provide to Company to communicate with users about our Service, including service-related notices. You acknowledge that these service-related notices are necessary for the provision of the Service and you may not opt out of such service-related notices.

How we use and share Information

We use information you provide and information we automatically collect to administer the Service and to allow you and other users to use the Service.  You understand that certain information, such as the information users provide in response to test questions or in communication with other users will be shared through the Service and will be accessible to other users in the Community. 

Please note once you have posted information to the Service or communicated with another member of the Community through the Service, we cannot control how the Community or other users may use any information which you may provide and we hereby disclaim any liability associated with such use or disclosure.  Additionally, the Community may have access to your information including as posted to the Service and may use such information in accordance with the Community policies.  

We may use your information to improve our Services or to send you related information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages.    

We will disclose information to our service providers that work on our behalf or with us to provide the Service.  A list of our current service providers is available upon reasonable request.  We do not permit these providers to use your information other than as necessary to provide the Services to us.  We may disclosure your personal information with your Community or those as directed by your Community.  We may disclose your information if we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or other governmental or law enforcement request, (b) enforce our Terms of Service, including investigation of potential violations, (c) detect, prevent, or otherwise address fraud, security or technical issues, (d) protect against or mitigate harm to the rights, property or safety of our company, the Service, its users or the public as required or permitted by law, and (e) in order to respond or report on reports of abuse or misuse of the Service.

We may also share aggregated or de-identified information in our sole discretion.

If we use this information in a manner different than the purpose for which it was collected or other than as disclosed in this policy, then we will ask for your consent prior to such use.

Corporate Events

If our company becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, your information may be included in the assets sold or transferred to the acquirer.  You hereby agree that we may transfer or assign the information we have collected from you in connection with any such event.   In the event of a bankruptcy, insolvency, reorganization, receivership or assignment for the benefit of creditors, we may not be able to control how your personal information is treated, transferred or used. 

Information Security

We will take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures.  However, we cannot guarantee its absolute security or that unauthorized persons will not access or use your personal information for improper purposes.  In the event of a breach of security affecting personal information on our servers, we will take such notification and other steps as may be required under applicable law.   We ask that you do not send us or post any highly sensitive information on the Service, such as Social Security Numbers, personal health information, Driver’s License numbers and the like.   We will not be liable for the use or disclosure of any such information if posted through the Service.

Controlling, Accessing and Updating Personal Information

You may update, change or correct your personal information through the Service.   You may also request that we deactivate your account.   Upon request, we will use our reasonable efforts to deactivate your account and delete your personal information from the Service in a timely manner.  We will use reasonable efforts to delete personally identifiable data as requested if it is not otherwise required to be retained by law or for provision of the Service or other legitimate business purposes.  However, you acknowledge and agree that information you have shared through the Service may no longer be within the exclusive control of Company  and Company is only responsible for removing data or information within its possession or control.  You may be required to confirm your identity before processing such requests. 

We will update your account and information as requested, provided, that we may decline to update information if we determine it to be impractical (for instance, requests concerning information residing on backup tapes or other historical data). In any case where we provide information access and correction, we perform this Service free of charge, except if doing so would require a disproportionate effort. Further, after you request that we delete your information from the Service, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems indefinitely.

Third Party Sites

This Privacy Policy applies to the Service. We do not exercise control over any other sites that may be linked to or accessed through the Service or our website.   We have no responsibility for the privacy practices of other Web sites. You should review the policies of any third party sites before providing personal information to these sites.

Location of Servers

We process personal information on our servers in the United States of America. If you are accessing the Service from another jurisdiction, you hereby consent to the transfer and processing of your personal information in the United States.

Tracking

We do not track or collect personal data about your online activities once you leave the Site or Service. 

Children’s Privacy Policy & COPPA Compliance

The Company is committed to protecting the personal information of our youngest users.  This Children’s Privacy Policy explains to parents and guardians (“Parent” or “you”) qualified educational institution (“Schools”) or other Communities (as defined in the Terms of Service) (1) how we collect, use and share personal information from users of the Service who are known to be or identify themselves as under 13 years old (“Children”), (2) how you may limit the collection, use and sharing of your Child’s personal information, and (3) the role of your Child’s School in this process.

This Children’s Privacy Policy does not apply to users 13 years old or older; such users should refer to the general Privacy Policy above.

1. COPPA

We are required under the Children’s Online Privacy Protection Act (COPPA), with limited exceptions, to obtain verifiable parental consent before we collect, use, or disclose personal information from Children. COPPA allows the Child’s School to act as the parent’s agent for the purposes of consenting to the collection of personal information from Children by a website operator, such as Company, but only in the educational context.

If a Child wants to use the Service, he/she must be a member of a School or other Community that has executed a Subscription Agreement with the Company.  The School or other Community will secure the necessary consent from the Parent prior to transmitting any personally identifiable information of the Child to Company.  Company may rely on the School’s transmission of the Child’s personal information to Company as confirmation that it has received consent from the Child’s parent.  If the Child will be accessing the Service through a Community that is not a School, Company will cooperate with the Community to secure verifiable parental consent prior to the disclosure of any personal information of the Child to Company. 

As required under COPPA, we allow Parents, upon request, to review their Child’s personal information that has been collected by Company, have that information deleted and prevent any further use or online collection of the Child’s personal information. 

2. INFORMATION YOUR CHILD PROVIDES

We collect information about your Child in various ways in connection with the Service.   In connection with the registration for use of the Service, we request the Community provide the first and last name of each student that will use the Service, their birth date, and their class and teacher name.  We may also collect any information your Child provides directly through the use of the Service, such as your Child’s test answers or messages sent through the Service.

When a use[A1] r we know to be a Child contacts us by sending us an e-mail or using any of our contact forms, we will collect any information that is contained in (and/or attached to) the Child’s e-mail, text message, or that the Child enters into such forms. If a user we know to be a Child provides feedback to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with the Child’s personal information. We will collect any personal information contained in such feedback and will treat the personal information in it in accordance with this Children’s Privacy Policy.

3. INFORMATION YOUR CHILD’S SCHOOL AND TEACHERS PROVIDE

The Service allows the Community to access the Child’s information and interact with the Child in connection with his or her use of the Service.  For instance, the Child’s teacher may review and respond to a Child’s test results and track the educational development of the Child using tools provided by the Service.

4. INFORMATION AUTOMATICALLY COLLECTED VIA TECHNOLOGY

When your Child uses our Services, some information is automatically collected. For example, when your Child uses our Services your Child’s computer’s operating system, Internet Protocol (IP) address, access times, browser type and language, and the website your Child visited before our site are logged automatically. We also collect information about your Child’s usage and activity on our Sites.

Cookies: Like many websites, our Site may automatically collect information using “cookies.” Cookies are small data files stored on your Child’s computer’s hard drive by a website. Among other things, cookies help us improve our Services and your Child’s experience. We use cookies to store user session data, remember your Child’s account settings and determine if your Child’s computer system is compatible with certain technologies, such as Flash and JavaScript.

5. USE OF DATA

We may use the Child’s information provided to the Company and the information we automatically collect to administer the Service, to improve our Services, and to allow the Child and other users to use the Service.  You understand that certain information, such as the information users provide in response to test questions or in communication with other users will be shared through the Service and will be accessible to other users in the Community. 

We may disclose your Child’s information to our service providers that work on our behalf or with us to provide the Service.  A list of our current service providers is available upon reasonable request. 6. PARENT’S CHOICES REGARDING PERSONAL INFORMATION

We provide Parents the following choices with respect to the collection, use, retention and disclosure of their Child’s personal information.  A Parent may review his or her Child’s Personal Information, by contacting Company at the contact information provided herein.  Company will comply with all such requests in a reasonably expedient manner.  After reviewing the Child’s personal information, the Parent may ask us to update or delete the Child’s personal information. Further, a Parent may prohibit us from making any further use of the Child’s personal information or restricting its use.  However, Company reserves the right to deactivate the Child’s login information and prohibit the Child from any further access of the Service if, in the Company’s sole discretion, such steps are necessary to comply with the Parent’s requests for limited use of the Child’s personal information.  Company shall have no liability whatsoever for any termination or deactivation of Child’s account. 

After a Parent requests the deletion or modification of certain of a Child’s personal information, we will remove such information from the Service, however, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems indefinitely.

8. SECURITY OF YOUR PERSONAL INFORMATION

We are committed to protecting the security of your Child’s personal information. We use a variety of industry-standard security technologies and procedures to help protect your Child’s personal information from unauthorized access, use, or disclosure. While Company uses reasonable efforts to protect your Child’s personal information, Company cannot guarantee its absolute security.
